    1. CD-AUDIO - Licensing
    Reproduction rights
The musical composition, which is fixed on a support, like a tape or a cd, is copyrighted. You need to obtain a mechanical reproduction license in order to make copies and distribute them, even if the copies are given away for free (promotional). The publishers usually control the rights for the musical composition. Reproduction rights agencies issue licenses and collect royalties on behalf of their publisher members.

    Sound recording
The physical sound recording itself is covered by a copyright. Whenever you want to use an existing sound recording, you need to have a permission from its owner . In general rule, the label is the owner of the sound recording. Independent artists may also own their recordings.
  • Generally, the owner of the sound recording is the company or person next to the encircled "P" on the label of an album or compact disc. For example, Pearl Jam’s "Vs." album lists "Sony Music Entertainment." Thus, if you want to obtain a license for the recording of a track on "Vs.", you should contact Sony Music for a license.

If you need help to find out who is the owner of a sound recording, reproduction rights agencies (see contacts above) may assist you in your research.
